The man accused of killing his wife while on their honeymoon in Australia goes on trial today in Birmingham. Gabe Watson served 18 months in an Australia prison on manslaughter charges. He's now facing murder charges in Birmingham.
The prosecution is going to have to prove that Gabe Watson hatched part of the plan here in Jefferson County before leaving for their trip to Australia in order to get these charges to stick.
Tina Thomas Watson's death has made headlines since 2003. Her newlywed husband, Gabe Watson is at the center of the controversy. Some believe her death is a complete accident, while others are crying murder. Now this case is finally going to trial in Alabama, nine years following her death.
The road getting to trial hasn't been easy. Every step has been monumental; one of the biggest being Watson's arraignment in Jefferson County on capital murder charges back in January of 2011. At that hearing Thomas' family said, "I think once the evidence is heard that the right outcome will happen."
Another family member said, "It's never been presented to a court so if we can get the actual evidence presented I think it will be a different ball game altogether."
While Thomas' family is convinced Watson killed Tina, others are not.
Tina drowned while scuba diving with her husband. Watson pled guilty to manslaughter charges in Australia, meaning he pled guilty to not acting intentionally but negligently when he left his drowning wife. He served 18 months. His attorneys say that was an accident not murder.
The defense feels Watson has served his time, while state prosecutors say 18 months isn't nearly enough.
The trial is set to begin this morning.
